I’ve been thinking a great deal about my clients lately and while I handle many different types of personal injury cases, I realized that all of the victims and victim’s families that I work with have one thing in common-
They Never Saw it Coming.
All of them during one regular day or during the course of a perfectly normal night, were plucked out of the routines of their daily lives in an instant. Many had their lives turned upside down and instead of planning to go to child’s soccer game that night, they instead found themselves in an Emergency Department injured and in pain, and racking up huge bills. Unimaginable bills that they’d never planned for. Some of my clients were injured in a car accident while driving to work, others have fallen in supermarkets and convenience stores, a few have been victims of horrific medical malpractice. I’ve also had clients attacked by animals while simply performing their jobs. Imagine just for a second how that must have felt…. the fear, the shock, the knowing that they never saw it coming.
While it might seem that the accident is the worst thing that could ever happen, working through the recovery from a serious accident can also be the worst thing the victim will ever face. You see, not only do victims have to focus on healing, but they are also tasked with fighting against insurance companies, negotiating with medical providers, and trying to physically and mentally heal. That’s a lot to ask of anyone who has been injured.
Unless the victim works for an insurance carrier, they’ll have to educate themselves about the process to ensure that they receive a fair settlement. Insurance carriers will not automatically offer victims a fair settlement, the victim will have to fight for it. They will not tell the victim to finish treating with his/her medical providers before accepting a settlement from them, they will not tell the victim to wait until he/she knows how much the total medical costs will be before accepting their money, they won’t remind him/her to include lost wages or to factor in future medical expenses. They will simply offer the victim a low settlement, one that is just enough to be tempting, because they want that victim’s claim to simply “go away.”
