Recently, I handled a case involving a Virginia resident who was working for a Virginia heavy equipment company. His company, and he in particular, was hired to work on heavy equipment at a mine site in West Virginia for a West Virginia company. While assisting that company in repairing a piece of equipment, he was injured. He hired another lawyer to help him with that claim. That attorney was a worker’s compensation attorney and advised him of that claim only. That attorney was not licensed in West Virginia, and according to the client, only told him of that claim. Based on that advice, the client filed a Virginia comp claim only, received treatment and eventually settled that comp claim after his neck surgery.
Nearly 2 years after the incident, he consulted with me to evaluate a medical malpractice claim. My investigation revealed that he did not have a malpractice claim, however, in my opinion, he still had a claim (a third party claim) against the West Virginia company where he was working the day he got hurt.We were able to file a lawsuit and eventually obtain a near 7 figure recovery for the client before trial! This was in addition to my client’s original worker’s compensation settlement! This claim was missed by his initial attorney, as well as other Virginia attorneys he had evaluate his case.
